Legal Question in DUI Law in California

17 Year Old Arrested for Minor in Possesion of Alchol & Tobacco

My son & myself are scheduled to appear in court. He was arrested and cited for minor in possession (of an unopened champagne bottle) and minor in possession of cigarettes. He blew a .04.

The notice requests one or both parents and for him to bring proof of a drivers' license. Will they be taking it from him? Will I be in trouble since he was arrested at 3 a.m.? Thank you.

You have to appear in court to represent the minor. You may have an attorney present, but the parent needs to be there too. They'll ask if you want to set the case for trial or plead to a minor infraction. They will not likely take away his DL, and since you are not charged with anything, nothing will happen to you. Get a lawyer to help you. Good luck.
