Legal Question in DUI Law in California
Back in 2008 i got caught with a DUI and on my wallet i had the driver license of my twin brother and due to my alcohol level i didnt notice that they took his license and booked me with his name ... So my question... Is there a way to fix that without getting charged with identidy theft and withouth jail time?

Anything is possible. IF you turn yourself in voluntarily and your attorney is able to persuade the court to straighten this out correctly, yes. However, if you are saying that you never dealt with the DUI yourself, and there is a warrant outstanding for 'your brother', then you are going to have to face at least the normal penalties for DUI.
