Legal Question in DUI Law in California

CA DUI, what are my real chances?

I was charged with my first DUI--Five beers in four hours doesn't seem like that much to me but being tailgated by a police car about a foot from my car makes me nervous, wasn't driving irregular, no problems with coordination (other than standing on one foot), declined breathalyser for blood work, was never mirandized, and felt I was treated differently for asking the officer to repeat himself, to be specific, and asking what my rights were.

I also understand bloodwork may increase the alcohol content of my blood because it's done much longer after I was actually driving.

Is there actually any chance of proving my innocence, or is this something that with or without a lawyer I'm going to end up paying finds and losing my license?

You need the help of an attorney that is local and deals with DUIs regularly. I am in San Diego, and would be happy to consult with you on this situation.

It is unfortunate that you have to deal with this situation, but you want to go into court knowing the system will not be able to simply railroad you.

"Proving your innocence?" No.

Defending the charges with experienced counsel, yes. However, the only way you are going to avoid penalties and fines, including suspension of license, is to win at trial. Attorneys exist because they get better deals for their clients than people get for themselves.
