Legal Question in DUI Law in California
do i have a chance
Yesterday I had been helping my friend move. He left a soda inmy car and when I was driving home I was thirsty so I gulped what wasleft. Right after I stopped drinking it I could taste that there wasalcohol in it. I started to get to the right so I could get off the exitbefore the alcohol took effect when I rear ended a guy (going about15-20mph) nothing really happened to his or my car but we pulled over sowe could exchange information. We were about done exchanging informationwhen a CHP officer pulled up. (about 10 minutes after everything hadhappened. By that time the acohol was starting to take effect. He cameover to talk to me and could smell the alcohol on my breath and procededto arrest me for DUI. I am 20. Do I have a chance at winning this case since I was not driving under the influence or am I basically screwed?

Get an attorney to represent you and present the facts as best they can. If he thinks you can win at trial, consider doing so. You may be able to negotiate a plea bargain you can live with. Feel free to contact me if serious about getting the legal help you'll need, if the case is in SoCal.

You absolutely have a chance to put this behind you. If this is all you drank, and it was very near to the time you were talking to the officer, there is a good chance that your blood alcohol was under the legal limit. I would very much like to discuss this case with you, regardless of where in California it is. I believe you have the right to competent counsel in any part of the state, and after we discuss this, I think my office would be a very good choice to defend your rights in this matter,
