Legal Question in DUI Law in California

Charged with DUI. Cops never saw me behind a wheel...

One night I had a couple of bears (I am 6' tall, 225 lbs). When I was driving home (just a few blocks), I got into a car accident. I was driving along when I saw a cat crossing a street in font of my car. To prevent hitting it I turned the steering wheel. My right front wheel hit the curb, which knocked a steering wheel out of my hands, the car followed front wheels, got out on the sidewalk, and hit the street-light post. When police arrived, I was standing on the street next to the car. Cops never even saw me sitting in the driver seat. Nonetheless, the officer took me down to a police station, gave me a breath test and charged me with DUI. Is there a way I can win this case? Thanks.

There is always a way to fight a case, including a DUI. I would need more information to better estimate your chances of winning, but you do have a good possibility depending on the circumstances, and any witnesses to your "drinking".
