It will most likely be heard in Federal court, applying California DUI laws.

Federal courts tend to impose more stringent conditions after a DUI conviction; for example, the often require formal probation, even on a first offense, while state courts usually impose informal probation.

Your question is pretty vague, so it's hard to give much of a specific answer. You should definitely seek advice from an experienced DUI attorney in your area who has also handled cases in Federal court.

By your attorney, in the US Disctrict Court into which you were 'cited' on your ticket or jail release forms. This is NOT like going to your local state court and getting a quick 'deal'. Take this real seriously. Federal judges do. Also know that you have only ten days to file an appeal with DMV to avoid one year automatic suspension of your license. If serious about getting legal help with this, feel free to contact me.
