driver's license confiscated
An officer retained my driver's license when I was in an accident. THe hospital recorded my BAC at .08. Can he now charge me with a DUI?

Of course. And, he didn't need the BA report to do so. You need to assume you will be charged, and possibly sued by the other party. Make sure you notify your insurance company and file an accident report with the state.
