Legal Question in DUI Law in California

Drivers license suspension

I was arrested for a dui. I blew a .09. I imeadiatly hired an attorney. My attorney represented me in the DMV hearing and they suspended my license. Six years ago I was convicted of a ''wet reckless''. I have not setteled the case in court yet.

I am a small business owner and now I am unable to renew my garage liability insurance. It is my beleif that the insurance is manditory. I would not want to not have it anyhow. I am running my business as a partnership. My insurance agent has tried all of the major carriers and none of them will touch me.

Here is my question; Is it possible to appeal the dmv's decision? If so, who would I contact to do so?

Re: Drivers license suspension

You can appeal, but the reality is that they seldom succeed. It depends on having some kind of special circumstances, regarding the arrest, not your business. Unless you could convince the appeal judge to show sympathy, you are taking a long shot. That assumes you are still within the time limits of filing the appeal, which limits are spelled out on your DMV notice of ruling. If interested and willing to 'take a shot' at this, contact me to discuss the fees and costs.
