Can a minor be charged with driving other minors if they are drunk

I support Designated Drivers and I commend everyone who performs the task. However, the state legislature keeps passing laws to single out and punish young drivers for things that would not be crimes if they were committed by older people, and it would not surprise me if they have made being an underage Designated Driver a crime.
