Legal Question in DUI Law in California

Drunk in Public

I got a DUI about a year and a half

ago and then last night was picked

up and stuck in the drunk tank and

got a Drunk in Public. I have a court

date next month and I was

wondering how my DUI effects the

Drunk in Public and what should I

expect to happen when I go to

court?

The DUI doesn't necessarily affect the drunk in public charge - it kind of is what it is.

The bigger concern should be a violation of probation allegation. I assume you're still on probation for the DUI. Under the terms of probation, you aren't supposed to violate the law or you could face additional punishment from the DUI.

Beat the drunk in public and you potentially beat the probation violation. It's worth an attorney, given what's at stake.

Drunk in public is ussally not an offense where jail-time is given. The only thing that may cause a judge to give jail is the probation violation. I would recommend going to AA meetings and bring a 5 by 8 card so the person in charge can sign you off each time you go. Bring a document showing you've attended 10 or 20 AA meetings and that may help. I always recommend seeking an attorney in your area for advice. Its usually free, and can't hurt. I wish you well.
