Legal Question in DUI Law in California

I got a DUI in May and my court date was on July 2nd. When I showed up to court, however, my name was not on the docket, and the clerk said that the police dept. had not yet filed a complaint about me. How long do they have to do this before my case can be dropped?

As long as they like, statute of limitation does not apply once you've been arrested.
