DUI - Failure to Appear

I received DUI citation in Sep of 97' in L.A., CA. Soon thereafter, I moved to NC and DID NOT appear. A warrant was issued for the failure to appear. I did blow a 0.08, and I did pass the field sobriety test. My thought is that I could have an atty. appear for me to take care of the warrant and then possibly have the DUI thrown out. Is this possible? Due to the suspension of my license, I have not been driving and have NOT had any driving convictions since then. My question is what recourse do I have and what can I expect.

This case will remain open until someone, (and yes, an attorney can clear this up for you), appears in court and recalls the warrant, and enters a not guilty plea. From there, although I am hesitant to offer specifics on any case I haven't seen, I would believe from what you've stated that your case may be dismissed.

Yes, an attorney can appear without your presence, with proper authorization in writing to the court. Getting the DUI thrown out is not likely, as the Blood Alcohol level convicts you. The best I can offer as hope is that the DA and court might be convinced to take into consideration your 5 years without further trouble, and allow a normal, reasonable fine. If presented right, you'll be ok. You have to do something about this or risk arrest back there if ever stopped or your records checked.

If you arew convicted, yoyu will need an NC attorney to help with the suspension here (one year but 24 hr privelege if no prior and over 21 when charged. I'll be glad to help on this end.
