DUI License Suspention in California

What steps (if any) will I need to take to avoid having my license suspended? I am 32, and this is my first offence and really need my license for work. Should I request a hearing from the DMV?

If you haven't already filed the DMV hearing request within ten days of arrest, you stand to lose the license automatically for up to a year. If you're already late, you'll have to take special steps to request the DMV set aside that 'default' and allow a hearing. Even at hearing, there is no guarantee of avoiding suspension of the license. Properly handled, with good facts and arguments, it might be possible to avoid suspension, or keep it to less than a year. Properly supported, you may also apply for a restricted license for work in some circumstances.

How your attorney handles negotiations on a 'deal' with the prosecutor and court will determine whether the court also imposes suspension, along with all the other potential penalties of jail and fines and alcohol schools.

If you would like to keep your license you should contact the DMV immediatly, you only have ten days to schedule your Admin Per Se hearing, following the citation. You will be able to apply for an occupational license following the Administrative hearing.
