Felony Dui with injury
My friend was a passanger & was injured in a dui accident in 11-04.The driver had hit the divider wall on a frwy. & spilt cleaning products all over & Haz-Mat had to come out & shut down the frwy. for cleaning. The driver had a BAC way over the Ca legal limit &was arrested & charged with Felony dui with injury, than released 24hrs later without seeing a judge. Charges are now being filed 7-04. The driver was issued his liscense back by the dmv in 12-04.I would like to know what the likelyhood of the driver serving time for this crime and having liscense revoked. The passenger suffered a broken foot, and received 24 stitches, and has had 3 surgeries on his foot. Please tell me the driver wont get away with this.

Have your friend who was injured call or e-mail me, and I will personally make sure the bastard pays!! Have him call right away as any delay could cause him to forfeit his legal rights.

It is up to the courts and DA to punish the drunk criminally. I am surprised DMV reissued, but the delay in filing charges was the likely reason. The passenger can sue for injuries, and should - assuming the driver or the registered owner had insurance, or at least has assets to collect against. Have him contact me if interested in doing so.
