Legal Question in DUI Law in California

Guilty or not guilty

I was drinking at my place of employment after hours with a co-worker and an off duty cop. After leaving I crashed my parents car and blew a .20 when I got to the police station. My father thinks I should plead not guilty to try to reduce the charges, and use the fact that I was with a cop and a co worker (who let me leave and drive) as a way to validate why I thought I was okay to drive. Will these circumstances help me in any way and will my employer and cop friend get in trouble? Should I plead not guilty or guilty?

Re: Guilty or not guilty

If you plead guilty, you'll simply be sentenced to the listed penalties and punishments of the law. Not guilty pleas allow defendants to negotiate a plea bargain or go to trial if necessary. Consult with counsel before making any decisions. If the case is in SoCal, feel free to contact me if serious about getting actual legal help, and not free advice.

Re: Guilty or not guilty

In essence, no, drinking with a cop or the pope doesn't help your case. You need an experienced DUI lawyer in your area to negotiate for you. Hire someone familiar with the courthouse that you will be in, or use the public defender, whose services are often excellent in this area.

Sadly, under your facts, it seems there might be little anyone can do but wank you through the process and make sure it does not get worse.

Best of luck.

Re: Guilty or not guilty

The best advice is to hire a lawyer and fight the charges. I dont think that you should plead guilty.
