Legal Question in DUI Law in California

joint suspensions

If you sign a joint suspension to get out of jail early for a DUI./wet reckless and also receive probation but you get a 2nd DUI and violate your probation will you automatically serve the time that was originally given to you in the joint suspension?

Re: joint suspensions

That's the potential, and the point of the 'deal' you agreed to for probation. You'll be charged with the new crime and violation of probation. It's up to your attorney to try to keep the punishment 'down'. If this is in SoCal, and if you're serious about getting counsel, feel free to contact me.

Re: joint suspensions

You would be nuts to plead guilty to a crime just to get out of jail early. Assuming you did this, and you do the same crime again, you are going to get hosed. You obviously didn't learn your lesson and you will get no love from the system.

Think of the situation as similar to cooking a TV dinner in a microwave oven. If you cook the meal for 6 minutes and it's still frozen, you'll have to zap it again. This is what judges do to repeat offenders.

Re: joint suspensions

While I rarely hear of joint suspended trgarding a dui , iy is possible if it;s a 4th dui, and therefore a possible felony, or the person had a prior felony for manslaughter or something akin to that. However if you receive a joint suspended sentence and you biolate probation, while you very well may get that sentence now, we have had several cases where we have been able to get sround that. Seek legal advice immediately. Thank you and I wish you well, David Wallin
