Legal Question in DUI Law in California
In July of 2007 I got pulled over by CHP (California Highway Patrol) in Needles, Ca., I originally got pulled over for poor visibility of my temporary registration card, he asked me where i was coming from and i told him the truth, the bar, i didnt see anything wrong with telling him the truth because honestly i only had 1 drink and 20 min later i left because the bar was closing. He didn't pull me over because i was swerving, or driving on the wrong side of the road or anything like that, NO, it was because of poor visibility of temporary registration, which i never did get a ticket for. Anyways i do the road tests and PASS but fail the breathing thing. ok fast forward, i go to court plead guilty, couldn't afford an attorney to fight it, get a $1500 fine, have to reg in dui class. I paid $100 on my fine never signed up for classes. I lost my job, and yes i realize financial hardship is not a significant argument in court. So lets fast forward to now, I find a site on the web to look up my information on my case it says
PROCEEDINGS
DEFENDANT FAILED TO PAY FINE TO THE COURT. DEFENDANT FAILED TO FILE PROOF OF COMPLETION FOR ALCOHOL PROGRAM.
COURT ORDERS PROBATION REVOKED FOR THE PURPOSES OF RETAINING JURISDICTION.
BENCH WARRANT ISSUED. BAIL SET AT $20000.00. MAY NOT FORFEIT. REASON: 5-ALLEGED VIOLATION OF PROBATION
CUSTODY STATUS
CASE CUSTODY - FUGITIVE
DISTRICT ATTORNEY NOTIFIED.
DEFENDANT NOTIFIED BY MAIL.
I probably was notified by mail, but in my ignorance i forgot to put in a change of add when i moved from there. Anyways thats besides the point. With all the info i provided, and i provided so much detail because i have asked this question before and i always get people telling me they need more info to accurately help me answer my question. obviously there is a warrant out for my arrest thats clear but now i want to take the necessary steps to clear this matter and get my license back and get my life back on track. i really can not afford an attorney, im not working at the moment but i have a way to pay my fines, i just cant afford to do both hire an attorney AND pay the fines. The bail that was set, $2000 is that on top of my past due fine, which is $1400? Am i going to go to jail even if i have the money to pay the fine? Has anyone ever had a case like this before and if so what was the outcome? Does everything just depend on the judges sympathy or mood for the day? I understand that it does not look good because it has been a few years and im just NOW starting to take care of this. In the postal code of this i put the postal code the incident took place in but I now live in Az. and the dui took place in Needles Ca. which is only a few min away so distance is not a factor in taking care of this matter. Ugh! need some answers please! if more info is needed please say so. I feel like Ive rambled enough though.
