Legal Question in DUI Law in California
Minor in Posession
I'm 18 years old. I was at the Over the Line Tournament on Fiesta Island. I arrived around 6pm to hang out with some friends. As soon as I got there I found out that they were ready to leave. I started to help one of my girl friends carry a cooler, but then she wanted to stop to take out some beer. She asked if I wanted one, I said no. She handed one to me anyways and I just took it figuring I would hand it to a guy friend following along behind us. When I turned around there were cops standing there that asked if i was 21. I told them the truth then they asked for my ID and proceeded to write me a ticket even though I was completely sober, had no intentions of consuming the beverage, and the container was closed. My question is how should I deal with this situation?

You can always hire an attorney to talk to the City Attorney to see if the case can be dismissed. If not, and the charge is for a misdemeanor and you are supposed to go to the courthouse downtown, a Public Defender will be there and will discuss the case with you.
However, you can always hire an attorney to represent you at all stages. Best of luck.

You do not want to be convicted of the charge you mention because 1 of the consequences would ne the loss of your driving privedge for 1 year. Speak to an attorney in or near your area. As a Former Deputy District Attorney, our office has handled 100's of your type of case. In many cases we can obtain a diversion type resolution that resolves with a dismissal of the charges. "Deal with it?" By going to court and defending it if you have any legal grounds and evidence in your defense. Most people hire an attorney who knows how to 'deal' with it and with the prosecutor to get a plea bargain. If this is in SoCal court and if you're serious about doing so, feel free to contact me.
