Minor in possession of alcohol citation

My son and his friends went to the beach and met others there. When he got there, people who were already there were drinking. The police showed up and asked him if he had been drinking. He stated ''no'' and was given a breathalyzer. It came back .00%. They asked him if he brought any of the alcohol and he stated ''no''. He was still given a citation for ''minor in possession of alcohol'' because he was a licensed driver as were 2 of his friends. The remaining 8 people (people who WERE drinking and were underage) were never given breathalyzers and were released to drive home. My question is can I fight this?

Your son can oppose this matter. This would best be done by retaining an attorney to represent him.
