Parked on shoulder of freeway
Hi my boyfriend recently was arrested for a dui, he had parked his car on the shoulder of the freeway because he felt tired and/or sleepy and felt he did not want to jeopardize the situation. So the Highway Patrol scouted his car and found him in there. The keys were not in the ignition. He had already called his sister to pick him up, so even before he got arrested his sister arrived. I want to know if it is still considered a dui even if you were not driving and did not have the keys in the ignition???

Apparently he drove the vehicle to the location where he was arrested. Depending upon the time he was parked, the blood aclohol at the time of the arrest he may well have been driving under the influence. He will need the services of an attorney to help him prepare his defense. The sooner he retains an attorney the better he will be prepared to defend himself.
