Legal Question in DUI Law in California

Hello

My question is regarding a criminal charge that i was given on 05-28-09. I need some legal advice on how to go about the situation. I have not been charged yet & although my case has already come before me, the court had no record of my case. Neither did the DA's office. I will explain further when i speak to someone thats assisting on this matter.

You should have gotten some proof from the court that you showed up on your court date. I recently had a DUI client in OC and I showed up for his first court date (if you hire a lawyer, which is a good idea, the lawyer can appear without you) and there was no record of the case. But the DA decided to file the case months later. In my view this could be a violation of your right to a speedy trial. Let me help you through this.

Don't talk to the DA's office before you have retained a lawyer.

Delays in filing by police create these situations. If you went to court on the date you were told, only to learn no filing was done, then sit back and wait for a letter from the DA indicating a new court date. When you get that, if you ever do, then contact me to discuss your problem. I'll be happy to help you. Until then, you're wasting your time worrying, and my time speculating on what's happening. They may decide not to prosecute.
