How can I reduce jail time in DUI conviction
How can I avoid or reduce possible jail time for a second DUI offense? My first offense was 6 years 11 months ago. My BAC for second offense was .16. Thanks.

Thank you for your posting. With a BAC double the legal limit, and a prior, you certainly are facing the possibility of jail time -- but that doesn't mean you definitely will get jail time. A skilled attorney can negotiate with the DA and court to point out weaknesses in the case, such as an invalid test, or failure to meet the elements of the crime. Enrolling in an alcohol rehab program also shows responsibility to the court, and acknowledges a problem that will be solved on your own, without jail. Aside from those options, many times a case can be negotiated from jail to home confinement, caltrans or community service, work furlough, weekend jail, or a private jail, meaning that you will not serve an actual sentence pending completion of the appropriate program.
