Legal Question in DUI Law in California
My son has had 3 DUI'S in less than 2 yrs. I would like to know if he will be going to jail and for how long?? all cases are with the San Bernardino County, CA. His first DUI was April 2009, 2nd one in June 2010, 3rd in July 2010. He has never been in jail, he only stays the night and they let him out the within hours. He will go to court for the last two cases next tuesday and i need to know what will the process be. I know he has to pay court fees but I don't know how long if he will do some time in jail. I sure hope not, he was caught both last time with no license driving.

The process is easy: he pleads not guilty and handles the case[s] just like any other criminal defendant. He has arraignment, possible motions, Pre-Trial hearing, and a Trial if there is no plea bargain reached. No one can predict the outcome, let alone do so without knowing all the charges, facts in the police reports, alcohol levels, his rap sheet, his attitude, appearance and demeanor with the police and now in court, his employment history, his attorney's experience and persuasive powers, etc. It is up to the DA and/or the Judge to set the penalties, as a result of plea bargaining, or upon conviction at trial.
