Legal Question in DUI Law in California
Suspended license due to a DUI
California, US. I got caught driving
picking up my niece from school
down the street (sobriety check
point) with a suspended license due
to a DUI. Horrible part is it happened
the day before my restricted license
were to be issued to me. Is jail time a
mandatory penalty? What are the
odds of me avoiding jail time if I hire
at attorney?

Re: Suspended license due to a DUI
Your odds are always better by hiring an attorney. It's true, and you wouldn't expect us attorneys to say anything else, would you? Your sympathy facts make it likely your attorney can minimize those severe penalties if handled right. If serious about getting legal help, feel free to contact me.
Re: Suspended license due to a DUI
It is impossible to answer your question because there is so much more that needs to be known. However, jail time is NOT mandatory. It is one possible penalty among others. Depending on many factors, jail may be easy to avoid. There are 2 ways to be punished here. 1. it may be a violation of your DUI probation, 2. it is a new crime that is being charged with its own penalties. Having a lawyer is the best way to avoid the harshest penalties. If you'd like to discuss this further with me, please don't hesitate to contact me. Good luck. Steve Mandell

Jail time is avoidable in almost any criminal action depending on many factors. There is a chance with a good lawyer that you can avoid having to go to jail, or at least get a very minimal sentence.
