Legal Question in Elder Law in California

Answering a complaint on a civil suit

I recently got served for a civil suit

from my 90 year old grandma, she is

claiming that I schemed a plan for

her to take a loan out her house and

then spent her money. This is

completely false so I hired a attorney

to take care of this but he wants to

take this to mediation and has

charged me $7,500.00 so far and

nothing has been done. I don't have

anymore money to put into this. How

can I answer this complaint as pro

per and what are the steps I have to

take?

I have suggested to my attorney to

have my grandmother evaluated, but

he says he wants to wait. I think he

milking me for any money I can give

him

Re: Answering a complaint on a civil suit

You can go 'pro per' anytime, and can file all the documents needed to pursue your defense. Your problem is that you will have to learn all the rules and procedures to follow to avoid screwing up your case. Contact the local Lawyers Referral Service to see if there are any local attorneys willing to help you at reduced rate or pro bono.

$7500 should have already bought a great deal of work, including an Answer or Motions. You may be due a refund.

Typically, $7500 should have gotten you much farther, but each case is unique. Feel free to email or contact me offline and I would be happy to provide you, by way of comparison, how much your defense would cost were I representing you up to this point.

Yours truly,
