Legal Question in Elder Law in California
My brother is hitting my elderly mother, bothers him in her home. We need to keep him away from her. How can we get a restraining order?

By filing for one. You go to the local court and get the forms from the clerk, fill them out, have the sheriff serve them, and go to court on the hearing date with your witnesses and evidence. You can also call the police to have him arrested, and they or the DA will initiate a restraining order as part of the criminal charges.
