Legal Question in Elder Law in California

conservertorship

mom has advanced alzheimers, and

is in a rehab facility awaiting decision

to go back to her apt with supportive

care or into a long term home. The

family wants her to be independent

as long as possible, but we do not

have access to her finances to pay for

whatever is decided. I am told we

need conservortorship now. What is

the process? What sort of

documentation and records are

necessary?

file a petition for conservatorship. you might want to retain an attorney.

The process is obtaining a court order for someone to take charge of her assets and care. It is a filing like a lawsuit, in probate court. Costs and fees will have to be paid, so you need to discuss that as part of the decision process. Consult local counsel, call the Lawyer Referral Service if no one responds on this site.
