Legal Question in Elder Law in California

Elder abuse

i suspect that my parents are victims of FIDUCIARY ABUSE.there is only one problem it is by a family member.the member in question has accquired the responsibility if handling the paying of bills for my parents.it was given to them when my father was hospitalized for a medical condition.during which time there was a question of POWER OF ATTORNEY.much to the dissent of said family member dad did not grant POWER OF ATTORNEY.dad is now fine but said family member is trying to convince our family that dad is suffering A.D.D. and geriatric depression.this family member has no knowledge of medical practice so how can they do this?mom has never worried about $$$ up until now.it is not my business so i never asked.now mom has told me of $$$ problems.i live w/parents and always have.i support myself $$$ wise and i give parents $$$.The said family member has been brainwashing my parents for the past 2 yrs.what stes can i take legally to stop their actions and influence on my parents?

If they haven't done so (and are still competent), your parents can write estate planning documents (including a power of attorney) that puts someone else in charge. If they are not competent, you can apply to the court to be their conservators. While a conservator is a drastic step, it puts someone else in charge of the finances and requires bonding and regular accountings.
