Legal Question in Elder Law in California

Is home care co. liable for caregiver's abandonment, etc.?

Mother became debilitated and we contracted 24/7 caregivers (one person 5 days a week, another person on weekends) C.g. lied about having valid driver's license, yet still drove. Car insurance was cancelled when AAA found out, but c.g. destroyed notice from AAA. Finally, c.g. took car and left Mom home alone for over 2 hours. (My sister's surprise visit caught her gone.) Other misdeeds also occurred.

Any recourse against care company with whom we contracted for services?

Possibly. The question is how you measure the damages. You should discuss the misdeeds with an attorney who can evaluate the claim.

Absolutely, but, in this is a very big but, what are the damages. Did he would get hurt, was the car damaged, real life damages. You see you really do have certain claims against the company, and I'm sure they would not be happy with any publicity but the same time the amount of damages you could collapse will depend upon the real life damages you of suffered. What you really need to do you see an attorney right away. An attorney versed in elder law who can evaluate your case and tell you not only what your rights are the evaluate approximately what your damages are. Then you can determine whether or not you wish to proceed.
