Legal Question in Elder Law in California
My Mother received widow's aid when her husband whom she was seperated (not divorced) from passed, but he had remarried and the new wife also received this aid, now the SS office is requesting she refunds them 19.000 she is older and she survives only with the help she gets from SSI, they even told her she has 3 months to pay this amount, what can she do since she was still legally married when her husband passed?
1 Answer from Attorneys
There is no simple answer for her, other than that she now must try to defend the claim and sort out how to handle it, either informally or in court if they sue or file charges. If serious about hiring counsel to help in this, and if this is in SoCal courts, feel free to contact me. Ill be happy to help fight and get the best outcome possible, using whatever defenses and sympathies there may be.
