Legal Question in Elder Law in California
I have power of attorney. I have taken care of my father for 3 years and my brother has not seen or been a part of his life for 3 years. My brother has petitioned to get conservatorship of my father. We had a confrontation at the home where my father is living. My concern is can he get a restraining order against me from seeing my father ?

The simple answer is that it is possible for your brother to apply for such a restraining order and also possible for your brother to get appointed conservator if you do not object. It sounds like a very serious situation and you really need to hire an attorney immediately to protect both you and your father.
Anything is possible, if not contested by you. What you need to do is promptly file an opposing 'counter Petition' seeking appointment of you as conservator. If serious about hiring counsel to do so, feel free to contact me.
