Legal Question in Elder Law in California

proposing a voluntary conservatorship through a bank

a greedy relative has accused a very old lady of being dangerous and incompetent. she is neither, but a temporary conservator was appointed. The conservator shut off all access to her funds and even shut off her mail. she has to appear in court very soon to answer incompetency charges.

she does need some protection on money matters and I want her lawyer to propose a voluntary conservatorship through her own bank.

What are the advantages of a voluntary conservatorship?

Any drawbacks?

Are judges in general amenable to this type of suggestion?
