Legal Question in Elder Law in California

I'm not sure if my question falls under Elder Law or Medical Malpractice or Health Law.

My father was staying at skilled nursing facility due to a fall he had at his assisted living. Requiring that he have rehabilitation to strength his legs to prevent falls again. I received a call at exactly 4:42am that he had fallen again and was hurt and was being taken to the hospital. When I got to the hospital i found him badly hurt. His face was swollen and bleeding from his mouth and nose. After doing a ct scan they informed me that he bleeding in his brain. I went back to the skilled nursing facility to find out what exactly happened. Not only is their information on the nurses' report incorrect. They told me that they can not provide me with a copy. According to their own nurses' report he was left alone at the nursing station and found in this condition. But their time stamps for the incident are for 4:50am. When at 4:42 they called me to tell me what hospital he was at. I'm worried that I'm not being provide with the real information of what happened. Which is something the hospital would also need to know to provide him with the best care possible. What are my options here? I can't even get a copy of the nurses' report from them.

Seems like they have altered the records, which can be criminally investigated by the cops. I suggest you file a police report. Lawyers cannot conduct the same type of investigation that the law enforcement can do. Feel free to contact my office for further info. or representation.

your options are to try doing something yourself, or to hire an attorney to represent you. This may be, as you indicate, malpractice/negligence for a civil suit.
