Legal Question in Elder Law in California
Real Estate Fraud
My grandmother is a 93 year old waoman that is in a wheelchair and is partially blind, and partially deaf.
One of my older sisters has power of attorney over her
finances only. This sister name was on the deed as of
July/2004. Her name was forged and by my nephew and property
deeded to my nephew who then sold the property to a stranger
who took out a loan. How do I get property back in my
grandmother's name, Get loan rescinded, and obtain power of
attorney?
Sincerely,
Help!!!

Re: Real Estate Fraud
You probably don't get it back if it went to a good faith purchaser; we would have to see more detailed facts to decide. You can and should take action for recovery of the money against the family members, and action to get conservatorship of the grandmother to avoid further problems. Contact me if interested in doing so.
