Legal Question in Elder Law in California
sick, elderly parents.
My 91 year old father has incurable pancreatic cancer. He also has macular degeneration, and is taking two narcotic drugs-gabopentin and oxycontin- and he is on chemo. His oncologist continues to give him the chemo, and I am questioning this. He is sick from it, and it's not going to cure his cancer. The doctor knows that my father thinks this, yet won't tell him the truth, and the doctor knows my father is driving in this condition also. My parents are very good at lying to the doctors and putting on an act making them seem like they have clarity, when in reality they don't. They don't remember alot of stuff, they get confused, they repeat themselves, and my mother isn't making my father eat like he needs to with his cancer. When do my sister and I step in legally? After he kills someone driving?

Open a conservatorship.

If your parents are located in California, you must consult a Californian attorney about a guardianship. An Oregon attorney cannot help you unless your parents live in Oregon.

Long before. If he is dangerous, it is your duty to prevent harm. Seek a conservatorship if necessary to do so. Yes, it will cause emotional problems, but so will him killing himself or some innocent person.
