23 wanting restaining order in order to continue to stay rent free

My son 23 is attempting to serve (I guess) restraining order on my significant other in order (imo) continue to live in my dwelling. My partner is kind but impatient with son because of son's habits.

We both agree we'd help him anyway possible if he shows signs of creating his own success.

I was incarcerated 1 mo. ago when they argued, my son claiming verbal violence from my partner. I heard everything, it was minor. The Police took me away then gave me order of release.

Did not Mirandize me. I spent 13 hours in jail. Lost a days work.

I manage a grocery store. I have no record. My court case is on 26 Mar.

Son is on lease as minor. Thinks he's on lease as adult. Police at time believed him to be on the lease properly.

Son's room typhone. Habits; sleep all day, shower 2 hrs, eats everything. Not been seen 3 wks. call2nite 2 see when we're in to apparently serve papers.

Tonight rude kid with papers in hand requested my partner to receive. Partner not in.

Son has only just gotten a 3 day wk part time job and jr. college.

I've asked him to move since 18.

How do I go about this? I work all but 3-4 days a month. Do I go to the Marshall and advance eviction?

Sounds like either you need to move or to evict him, unfortunately.
