Legal Question in Family Law in California

My 42 year old son has been in prison and has a bad criminial record and in and out of jail. the mother of his kids and a baby and ended up in intensive care unit and coma for 5 months i took it upon myself because her family was already dealing with almost losing her so i took the baby and have been taking care of him since birth.they live in another state and my son dosen't want to send or take the child to see his mother so she has idea what the baby looks like we have no legal papers filed,she has been asking for her baby since she came out of the coma but i have gotten attached to the baby and it's now two years if she gets an attorney what will happen to me.

Mother has priority. She is likely to get a custody. A grandmother cannot have a custody, only guardianship.
