do i need to get an anulment, i got married in 2002 but his divorce was never finalized from his previous marriage and still isn't, do i have to get an anulment if technically we're not even married?

Technically you ARE married, but the marriage is invalid, and therefore needs to be undone. That is what an annulment is - a proceeding to judicially confirm that the marriage was invalid, to undo the pubic record of the invalid marriage, and to sort out the financial consequences of the marriage being undone.
