Legal Question in Family Law in California
He called off the engagment, now wants ring, but i gave it away a while back
Hi,
I was engaged and my ex-fiance broke off the engagement. I wanted to meet him after the engagement so we could exchange stuff, but he refused to meet me. He said that we should never have any contact with each other. I went to India a couple of months later, and gave away the ring (worth $3900 out of which I paid $1000). I really hated seeing away, and just wanted to get rid of it. Now, 7 months later, after having no contact all this time, he wants money for it!! I dont have the ring. Am I legally responsible?
Thanks.

Assuming that you are applying California law, if the ring was a gift to you it is yours to do with as you see fit.

If he claims that you broke off the engagement, he might be entitled to the ring back. If he broke it off, he probably is not entitled.
You could also claim a laches argument: he told me he wanted nothing back, I relied on that, I sold the ring, I don't have the money anymore.

Case law appars to support the proposition that if he called off the engagement, you are entitled to keep the ring. (asuming there is no fault on your part.)
