Legal Question in Family Law in California

child custody

My sister is using drugs and has a 7 year old Daughter, the environment that she is in, is unhealthy. My sister and the father of her child are no longer together and have not been for some time. My question is this, the father is an illegal alien, is there any way that he can take full custody of her? or can he get the child and keep her before he files any paper work? as far as I know there is no legal document establishing custody for either parent.

The child has been in foster care before due to the same reasons. I would like to avoid calling CPS if I can.

and if he cant get custody my husband and I would like to try, do we have any rights as Aunt and Uncle? We live in Michigan and both parents of the child live in Joshua Tree CA.
