Legal Question in Family Law in California

Child Custody-My husband has had his daughter living with us in California for almost a year now, her mother resides in Washington State, which is where the original parenting plan and custody were set up, since living here, her mother has had felony drug charges, we would like to modify the custody so that my husband legally has custody of the child, which state would we do the papers?

You may file a petition in California given that is the residence of the child.
