Legal Question in Family Law in California

I am currently behind in my child support payments. My ex doesn't receive nothing but 50 dollrs a month even though the state is garnishing my check. If my ex decides to re marry me, how would that change the child support situation?

If you two decide to get remarried then the child support can be stopped and the arrearages may be cancelled, unless your wife took out welfare or social services. Welfare would probably want that money back so they would not accept the cancelling of the arrearages. You can file a motion with the court to try to terminate child support if the parties marry since you would both be supporting the child again.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
