child visitation when drug use is admitted

during mediation and restraining order hearing the father of 7 month old admitted he smoked weed as recent as 2 months ago. because of his irratic and dilusional behavior towards the mother I would like to know why an immeadiate drug test wasn't ordered. there is another hearing on may 1 and there is suppose to be one ordered then. the mother (my daughter) is afraid that he might do something to harm the baby because of his dislike for the mother. She previously had a restraining order on him before the baby was born and she had it lifted so that he could be there for the birth of his daughter.

The mediator has no authority to order a drug test, only the judge. Your daughter should have an attorney because this is a tough case. Good Luck, Pat McCrary
