Custody battle

If I was never married to the father of my son and there is no court order of custody, but I am the primary caretaker and the father sees him one day for a few hours on the weekend, if the father kept wouldn't give him back to me after his visit could I get the police to get him back for me?

No. you would need a court order giving you custody.

Because you have not formally established custody, you or an attorney must file for an order awarding legal custody of your child.

The sooner you do that the better. Thus, I suggest that you do that first thing monday morning. If you have more questions

Your situation is very murky and probably a police officer could help you get the child back. Is "probably" good enough for you when it comes to the welfare of your child? Take care of business and get a custody, and child support, order to protect the rights of Mother, child and Father. Good Luck, Pat McCrary
