Legal Question in Family Law in California

A divorce was filed in Nevada,while both parents are here in the US,there was no order regarding custody of the children at the time. The father now lives abroad (internationally) for about 3 yrs already and has had no contact with the children. How can the parent with the kids here in the US obtain proof of legal custody of their children?
