Legal Question in Family Law in California
I don't want this divorce
I don't want this divorce. I was served on Monday. My husband moved out after I threatened a restraining order because he broke down my bedroom door. If I don't respond, will he really get everything he asks for? I am financially not in a position to hire an attorney but I don't want to lose my home. If I don't respond will I lose everything? or can I just appear in court and state my case then. My husband left me on 12-2 and then my Dad died on 12-15. I just don't have the energy for a war. What should I do?

This is understandably a difficult time for you. But it is important that you protect your interests, and that does require a response from you in the time alloted. It is worth your while to seek a consultation with a family law attorney. Many offer free initial consultations. Depending on the situation, it may also be possible for an attorney to get an order from the court requiring your husband to pay something toward your attorney's fees. You may locate an attorney in your area on this website, or through an attorney referral service. If you own a house and have equity in the house you should be able to find an attorney for little to start. The attorney can get an order for the balance of his or her fees from your husband or the equity in the house. He will not get everything he asks for, the property and debts will be split. He will probably pay you spousal support. Act promptly. You have a limited time to file a written answer with the court. You cannot just show up at court, you must file an written answer.
