Legal Question in Family Law in California
were about to get a divorce threw an agreement. my question is for the custody part of the case, theres child support owed but i dont want to collect at all is there a way not to. and is it better to go 50/50 rather than 20/80 or 30/80. and not collect or nobody pays.

It's good that you are trying to work on what is called an uncontested divorce through agreement. If thats the case you should probably consult with an attorney on a limited scope basis to make sure what you are preparing is going to work for you in the long run. As for not asking for child support, that is certainly something that you can do in your agreement. You just need to make sure that the language specifically states that nobody will be asking for child support and you will be taking care of the childs needs while in your respective care.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
