Legal Question in Family Law in California

If a document is filed by a respondent that is irrelevant to the case at hand, what are the terms and steps to ask the court to remove the document?

If you believe a document is objectionable, then you can file an objection to the document and state that it is irrelevant and ask that it be stricken from the record. Personally I have never seen that done in a family court because of the sheer number of self represented parties and the sheer number of irrelevant and inadmissible filings. The court however is not required and usually does not consider evidence that is inadmissible.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
