Legal Question in Family Law in California
can i drop charges?
about three weeks ago me and my boyfriend got into a argument. I called the police and he got taken away for violence towards me. what he is being charged with is spousal abuse. I have a demanded courtdate to go to, to tell the DA. the story and about him hitting me because they want to sentence him for whatever amount of time. honestly the incident was just a big misunderstanding. Is there any way i can drop charges or not press charges? I know that my ex-boyfriend doesn't deserve to be in jail. I just dont know what to do. also, if they decide to press charges for spousal abuse against what i say, what is a estimate of how much time he will get? thank you for your time.

Many counties have programs under which your boyfriend can go to domestic violence counseling and upon completion they will dismiss or reduce the criminal charges. This may involve no jail time but only probation. You both should get counseling so that you each know how to set boundaries in your relationship and work through problems without violence or intimidation. Good Luck, Pat McCrary
