A minor is still a minor in the eyes of the law and they do not have a choice in who they will live with. The reality though is teenagers are extremely difficult to control. The police may be able to help, if you contacted them for help in getting your child back. Since she is almost 18 in a few months, you should probably allow her to live with someone else if she is unhappy at home, but convince her that she should stay at home until at least she turns 18. Any legal action would traumatize the child and traumatize the family, and be useless since she would turn 18 so quickly before anything could happen.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
